TRADES POSTED: Letter to Ministry of Housing and Human Settlements

San Rafael de Heredia, September 18, 2008.

DPG-04-2008

Lord
Roberto Dobles Mora, Minister
Ministry of Environment and Energy

Dear Minister
Piedra Grande",
whose principles were adopted on September 2 earlier in the events hall is named, and whose content relates both to the Ministry of Environment and Energy, as the Comptroller's Office attached to the Office Environment.

As you know, Decree Law No. 65 of July 30, 1888 declaring the inalienable important areas of land, including some that are within our jurisdiction cantonal, such as Braulio Carrillo National Park, Sector Cerro Piedra-Cerro Chompipe-River Country, the Central Volcanic Range Forest Reserve and Wildlife Refuge and jaguarundi Dantas, which are an essential part of the zone of recharge Barva, Colima Colima Superior and Inferior that today supply the demand of water for human consumption, recreational, industrial and hydropower, both for the people of our province, as of a sector of Alajuela and much of Central Valley .

For this reason, and although it is the responsibility of the State, through the Ministry, ensure the protection and conservation of those areas, the inhabitants of San Rafael de Heredia, "according to the agreement adopted at the aforementioned" Declaration of Stone Great, "also were ready to join in the defense of natural water reservoir that exists in the wild that the Executive Order protects LXV.

To date, the aforementioned "Declaration" has been reported not only to our local government, but also to other public and private institutions could be interested or be directly affected by its content, including: the Board of the Public Service Company of Heredia SA, whose constitutive law also requires "... protecting watersheds, springs, streams and riverbeds, surface water flows and aquifers ..."
of our province (section 6 paragraph g) of Act No. 7789, 23 April 1998 Transformation Law ESPH), as well as the Board of the Costa Rican Chamber of Construction, in order to find out to housing developers and business groups linked to the guild, about rafaeleño people's opposition to install in our town:

"... urban and housing projects of high concentration and density, the risk of contamination to aquifers would generate: Barva, Colima Superior and Colima Inferior, this is because the construction, small lots of this type housing and the respective installation of individual septic tanks could be irreversibly vulnerable-areas aquifer recharge and discharge that exist in our county, due to relatively shallow water table presents those aquifers and high permeability of our soil, which affect water sources now feed most of our province and large parts of the Central Valley. "(See" Declaration of Piedra Grande "on 2 September 2008, 2 and Agreements 7 °)

This position is not new, but that in turn has its roots in called "Declaration of San Rafael", 27 November 1991.

Date on which the residents of that county also assumed, as one only, "
" ... its commitment to the joint protection of existing water resources in the area "
as a measure to ensure the solution to serious quality problem and quantity of water that sustained our town at that time, and in order to avoid that same suffering to future generations. (See "Declaration of San Rafael " , published in the Journal Heredia, December 1991). Despite these efforts, the studies of the National Irrigation and Drainage (SENARA), placed in protected wild areas of areas of high vulnerability to contamination of surface and ground water resources, by its topography and high rainfall in the area and of volcanic origin found in the soil permeability rafaeleño. Therefore, and based on the Precautionary Principle Environmental Law, known as "indubio pro natura", which the residents of San Rafael de Heredia have pledged to raise two actions of Amparo against any division, subdivision , segregation and / or construction set in danger of serious and irreversible Barva aquifer, Colima Colima Superior and Inferior cited to the local or national interest above that they have, but also to join, so serious, and responsible citizenship, to the measures promoted so far by our Local Government, and the ESPH-SA However, we are also ready to support any measure that dictates his ministry, as long as they seek to strengthen and not weaken the System of Protected Areas of flowing groundwater flow through the subsurface rafaeleño.

Unfortunately, political and business interests of our province, in apparent agreement seem to want to assign a less appropriate use our soil. This, because, according to statements given by the mayor of Canton Central de Heredia, "in a local station, the municipality would be interested in moving toward its neighboring counties, people in precarious settlements currently existing on the territory under its jurisdiction . Beyond such statements, and based on other evidence to corroborate it here

intention, hundreds of residents in the districts of Santa Barbara de Heredia marched to his own Local Government to prevent the construction in this county Project social welfare and the like, not only because of the serious impact they could have those aquifers, but also by the eventual desmejoría this could cause the quality of public services that currently provided to Canton residents (See Regular Meetings the Santa Barbara City Council No. 116, 117, 118, and 119, 15, 22 and 26 July, and August 5, 2008, respectively.)
Apart from the above, it also transpired that - a business group d
and Heredia, with clear political ties - would also be interested in the relocation of the squatter from that province, in order to exploit it later that same land, whose high value comes precisely from the current infrastructure that surrounds it, such as the Mall of Flowers, banks, private universities, Service Stations, Office of Goods and Services Trade in general.

For all the above, based on the Decree Law No. 65 of July 30, 1888, as well as Law No. 7554 of October 4, 1995, Environmental Law, which states the duty of the State to ensure the rational use of environmental elements DELIVERY MAKE FORMAL the Declaration of Piedra Grande "Mr Minister of Housing and Human Settlements, in order to corroborate, through the Environmental Controller attached to his Ministry, such acts constitute, or could possibly set up a social crime, particularly if it were to cause damage or contamination environment.
(Article 2 of Law No. 7554)

I This delivers on behalf of hundreds of residents who signed it, and as editor of this document and the "Declaration of San Rafael" of 27 November 1991, that referred to
