DIAZ GARCIA ROSARIO STATEMENT OF PETITIONER AS TO THE FOURTH COMICIÓN DECOLONIZATION
UNITED NATIONS (New York, October 2009)

President of the UN Fourth Committee, delegations, representatives, in my capacity as President of the Parliamentary Groups Peace and Freedom for the Saharawi people ", which includes all the groups working for the Saharawi cause in Parliament, Cortes and the English State Assemblies and in the Congress of Deputies and the Senate, which includes the set of parties represented in parliament, democratically elected and representatives of the English state is an honor to participate in such illustrious gallery, and bring before this committee the genocide of the Saharawi people

And this legitimate right to represent my speech and the expression of the English people to make them come to you for your complaint and voice. And for that, Mr. Chairman, delegates and representatives, transcribing step in this intervention, 7 points Institutional Declaration unanimously agreed by all parliaments and assemblies Cortes of Spain, and adopted on April 5, 2009, at the headquarters of the Parliament of the Canary Islands (Spain):

"1 - CONGRATULATIONS to the Saharawi people and on behalf of the Polisario Front - the only legitimate representative of the will of the people of Western Sahara - for resilience and while the dialogue, which has demonstrated against the injustice that is subject, and the continued effort to get the best both living in exile and occupation.

2 - CELEBRATE were initiated rounds of talks in Manhasset (New York) United Nations-sponsored, even knowing the intransigence of the Moroccan side, we have always wanted all success to them so they can help end illegal and illegitimate occupation of Western Sahara and the Kingdom of Morocco. But we regret the slowness with which it has developed and the events that led to its suspension and required replacement of the former envoy of the Secretary General.

We therefore urge international organizations, including the UN through the Security Council and the European Union to assume the responsibilities of Spain as a member, so that an urgent, effective action to implement that leads, without further delay, a self-determination referendum in which the Saharawi people to freely and democratically decide their future.

3 - notes with dismay that in the territories of Western Sahara occupied by Morocco, not only continues to unfold without limits repression against any kind of demonstration against the Moroccan position, but it increases, without shame, for Morocco. The abuse suffered by a number, and countless men, women and children, are not an obstacle to popular and peaceful resistance, increase day by day its activities across the geography of Western Sahara and where are the Sahrawi.

It condemns any violation of human rights produced in the territories of Western Sahara and we urge the United Nations High Commissioner for Human Rights to consider the Report issued by the Research Committee of the High Commissioner of United Nations for Human Rights to intervene on the process in an effective way to protect fundamental rights and lives of the population.

4 - We express our solidarity to all those who daily risk their integrity, their property and even their lives to record their opposition to the occupation and injustice. URGE ONCE AGAIN Human Rights Council United Nations to the publication of those reports have been conducted by the Research Committee of the United Nations High Commissioner for Human Rights and to intervene urgently and effectively to protect fundamental rights and lives of the population Sahrawi in the occupied territories. URGE

this Commission to characterize, formally, the territory of Western Sahara "occupied territory." This rating would mean the application of international humanitarian law and the application of the Fourth Geneva Convention of 1949, an agreement of which Morocco is a party since 1957 on the protection of civilians and resources natural. Also demand the release of all Saharawi political prisoners and the recognition of human rights activists and its committees.

also requests the UN Secretary-General of the extension of the mandate of MINURSO in the defense of human rights in the occupied territories and the protection of civil society.

5 - In this regard, we urge and requires EU governments to denounce the flagrant breach of international law on human rights by Morocco, as already done by the European Parliament. We further believe that the English Government also must do so because this is a responsibility that in relation to Western Sahara and the suffering of his people, it is entitled as former colonial power, colonial power when not de jure. The lack of reporting of such violations, does not correspond with the wishes of
the vast majority of citizens and institutions of Spain, such as those represented.

6 - URGE EU TO DEMAND, calling on the Commission, the EU, to respect international law in the agreements to subscribe for or are already signed with the Kingdom of Morocco, so do not affect the territory or the waters of Western Sahara, or political and economic rights of the Saharawi people.

7 - Since the cease-fire between the parties is the basis of UN resolutions, which seek to resolve the conflict, he stressed the need for Spain or any EU country to sell weapons Kingdom of Morocco in this delicate moment for the process, as this disturbs the peace efforts and suggests steps that could be happening to the resumption of the war by Morocco. "

We have heard, other colleagues and I we've gone over the years, in the occupied territory of Western Sahara, pending decolonization, stark evidence of the barbarity for years the territory. We met families of the disappeared. We knew that one day disappeared and treatment during detention after several decades, have become activists and human rights defenders who continue to suffer the torture of the police and the entire state. We have seen, first hand, that the international community, with Spain at the head, did not want to know anything about these people or the situation you have.

Mr. Chairman, delegates, representatives, for all it is the responsibility of the IV Commission to stop the genocide suffered by the population of Western Sahara. As both an honor to appear before you, is also an obligation to this REPORT forum this genocide and in my dual capacity as representative of Spain and civic institution that has proven reality, required to protect unarmed civilians and end the international embarrassment of holding by a commission of decolonization that is perpetuated over time military occupation exerted Morocco. These words resonate forever in the minds of those who have had to see the suffering and what the failure was caused by politics. Mr. President, delegations and representatives, that history does not judge us by the betrayal of this people, nor the next generations we point the finger of shame for our complicity.
