RESULTS OF THE FIRST STAGE OF THE NATIONAL DIALOGUE 2009

The people of Cuba want change, so last January we called the National Dialogue, as we Cubans are, without exception, we have to define ourselves, the changes we need. This is only possible if they guarantee the rights of citizens to participate fully in the definition of change. Hundreds of Cubans who fought peacefully for democracy and respect for human rights and other civil society members, have worked for months in the first stage of this dialogue, to make this proposal of first steps to make changes. Now we are presenting this proposal to all Cubans, without exception, they live inside or outside the country, all institutions and organizations and the government of Cuba to start a new phase of dialogue, to truly be national. And begin this new phase of national dialogue among all Cubans who wish to participate.

The first steps for change

I. Basic Statement

RESOLUTION

HUMAN RIGHTS, SEXUAL ORIENTATION GENDER AND IDENTITY

(Adopted at the fourth plenary session,
on June 4, 2009)

GENERAL ASSEMBLY

TAKING INTO ACCOUNT resolution AG/RES..2435 (XXXVIII-O/08), entitled " Human rights, sexual orientation and gender identity "

REITERATING:

That the Universal Declaration of Human Rights states that all human beings are born free and equal in dignity and rights and that everyone has all the rights and freedoms set forth in this Declaration, without distinction of race, color, sex, language, religion, political or other opinion, national or social origin, property, birth or other status;

The American Declaration of the Rights and Duties of Man establishes that every human being has the right to life, liberty and personal security;

WHEREAS the Charter of the Organization of American States (OAS) proclaims that the historic mission of America is to offer man a land of liberty and a favorable environment for the development of his personality and the realization of their just aspirations;

Reaffirming the principles of universality, indivisibility and interdependence of human rights;

NOTING the Declaration on Sexual Orientation and Gender Identity, submitted to the General Assembly of the United Nations on December 18, 2008, and

TAKING NOTE with concern acts of violence and related human rights violations perpetrated against individuals because of their sexual orientation and gender identity,

RESOLVED:

1 . condemn acts of violence and related human rights violations perpetrated against individuals because of their sexual orientation and gender identity.

2 . urge States to ensure that investigations into acts of violence and human rights violations perpetrated against individuals because of their sexual orientation and gender identity, and that those responsible face the consequences to justice .

3 . urge States to ensure adequate protection of human rights defenders working on issues related to violence and human rights violations perpetrated against individuals because of their sexual orientation and gender identity .

4 . request the Inter-American Commission on Human Rights and other inter-American system to continue to pay sufficient attention to the issue.

5 . reiterate to the Committee on Juridical and Political Affairs (CAJP) to include in its agenda, before the fortieth regular session of the General Assembly, the issue "Human rights, sexual orientation and gender identity."

6 . request the Permanent Council to report to the General Assembly at its thirty-ninth regular session on the implementation of this resolution, which will be implemented subject to the availability of financial resources in the program-budget Organization and other resources.
